INTRA COMPANY TRANSFEREES
An Intra Company Transferee is a employee working in a third country and he /she is being posted to an EU country to render services to a company which is in the same group of companies as his/ her employer.
The Law Implementing the Intra Company Transfer Directive into Cyprus is the Alien and Migration Law, Cap 105, (“the Law”).
A three step procedure is applicable for the entry and registration of third country nationals arriving into Cyprus as Intra Company Transferees (“ICTs”)
Work Consent
The Ministry of Labour being the competent body for providing work authorization, will, upon application, issue the work consent for the ICT. Work consent will be issued on the basis of the provision of the following documents:
a) Proof that the host entity and the hoe entity belong in the same group of companies
b) The corporate documents of the host company
c) Confirmation that the host company has no outstanding tax or social insurance obligations
d) An assignment agreement evidencing the assignment of the ICT into Cyprus
e) Proof that the ICT has been employed in the home company for at least one year
f) Receipts of social insurance contributions in the country of origin for the past twelve months
g) Evidence that the ICT possesses the specialist skills for which he has been assigned to in Cyprus.
Entry Permit
All non-EU nationals arriving for work into Cyprus must have an entry permit which is obtained by their representative in Cyprus. Entry permit is issued upon provision of the following documents:
a) Work consent
b) Application form MICT1/MCTM1, signed by the ICT and on behalf of the host company
c) Police criminal record from the country of origin (apostilled or legalized)
d) Medical tests from the country of origin Passport copy (apostilled or legalized)
Residency Permits and Biometrics Taking
Upon arrival the ICT must appear before migration for the issuance of his/her residency card and biometrics taking
The residency permit is issued and biometrics will be taken upon provision of the following documents:
a) Copy and original of passport
b) Proof of accommodation, (lease or hotel confirmation).
Note: Lease agreement must be stamped by the Registrar of Stamp Duty and stamp duty must be paid.
c) Health insurance valid in Cyprus
Required Documents for Renewal of the ICT
a) Application form MICT1/MCTM1
b) Extension of Work Consent
c) Passport copy with original passport
d) Proof of accommodation, (lease or hotel confirmation)
Extension of letter of assignment
Required Documents For Dependents of ICT/ Entry Permit
a) Application form MFR1
b) Passport copy valid for more than two years
c) Medical tests for HIV, Hepatitis B and C, Venereal Diseases and Tuberculosis
d) Marriage certificate/ birth certificates for children
e) Police criminal reports for any person above the age of 15 years.
Note: all medical tests and certificates must be apostilled or legalized
Required Documents For Dependents of ICT- Residency Permit /Biometrics
a) Application form MFR1
b) Passport copy valid for more than two years
c) Copy of page evidencing last day of entry
d) Cyprus Medical tests for HIV, Hepatitis B and C, Venereal Diseases and Tuberculosis, attested by a government doctor
e) Valid health insurance police for in and out of patience treatment, repatriation of remains
f) Copy of lease agreement entered into by main applicant.
